Certain aspects on cooperation between an advocate and a notary in the notarial probate proceeding

Abstract
The article considers the problematic aspects on participation of an advocate as a representative of a certain person in notarial probate proceeding. The article analyzes all the possible ways of advocate’s influence upon the process of notarial proceeding and the aspects of mutual influence of an advocate and a notary. By means of an example of one of the opening stages of probate notarial proceeding, connected with the acceptance of inheritance by the potential heir, the contents of the legal counselling and distinct features of his cooperation with the notary on the certain issue are being researched in the article. Legal counselling acquires special meaning: taking the final decision on possibility and necessity of his further participation in the probate proceeding shall be the result of complete awareness of a person about the essential circumstances and legislative provisions and also their competent estimation. The main function of legal counseling is in the notary’s notarial proceeding. Participation of an advocate as a representative of an heir does not contradict the goals and essence of the probate notarial proceeding.
