The concept and types of limits of administrative discretion

Abstract
In the article features of limits of administrative discretion and their kinds in law enforcement activity are considered. It is indicated that the right to use administrative discretion by a public authority or official is not absolute and unlimited. Administrative and legal discretion contemplates the existence of certain limits of its implementation in law enforcement activities. Establishing the limits of administrative discretion is an important guarantee of ensuring legality in the activities of the subjects of administration. Therefore, the administrative decision is not deprived of the property of legality and validity only on the grounds that the official exercises administrative discretion as a way of fulfilment of the most optimal, appropriate, necessary and socially desirable administrative decision.
