CERTAIN ASPECTS RELATED TO THE LEGALITY AND OPPORTUNITY OF ADMINISTRATIVE ACTS

Abstract
Unlike the old law of administrative contentious, the present law expressly defines the administrative act as "the unilateral act of an individual or normative nature, issued by a public authority in order to execute or organise the execution of the law, giving birth, modifying or extinguishing legal relations. They are assimilated to the administrative acts, within the meaning of this law, and the contracts concluded by the public authorities regarding: the capitalization of public property; execution of works of public interest; provision of public services; public procurement. Considering the legal definition above, we consider that there are proper administrative acts and legal acts assimilated to administrative acts. The law achieves its purpose and becomes effective only to the extent that its provisions are respected on the basis of the principle of legality. Administrative acts are legal in nature, but in order to be fully effective, they must be adapted to concrete conditions so that they become timely or timely.
