COLLECTIVISM AND INDIVIDUALISM AS FACTORS OF FORMATION OF LEGAL MENTALITY

Abstract
The article is devoted to the historical and legal analysis of the principles of collectivism and individualism as factors in the formation of the legal mentality of Ukrainian society. The phenomenon of “legal mentality” as one of the elements of legal consciousness, reflecting the everyday legal experience of society, influences the formation of national identity, which, in turn, is the basis of the national state, its security in modern conditions. Attention is drawn to the fact that collectivism and individualism are an uninterrupted, stable factor in the formation of a legal mentality. Throughout the entire historical develop¬ment of Ukrainian society, certain confrontations and contradictions of individualistic and col¬lectivist principles occurred in the sphere of state and legal reality, which led to their synthesis and the formation of their own, national legal mentality. Specific features of the legal mentality of Ukrainian society at the present stage of state reforms are determined. The author emphasizes the low motivation of liberal values in human life and human activities, as well as the need to achieve an optimal balance between the inter¬est of each individual and the interests of the collective.
