COMPAREMENT OF PRINCIPLES AND THE RULE OF LAW THROUGH THE PRISM FORMS OF RATIONALITY

Abstract
In the article the problem of correlation of principles and the rule of law from the standpoint intellect and rational thinking. It is shown that in the Ukrainian legal role and significance of the Right underestimated due to the predominance of stereotypes and codes intellect lehistic thinking and rejection of purely legal (natural law) type of thinking that is embodied and expressed in rational thinking. The necessity of modern legal thinking.
