COMPARISON OF MAIN NORMS OF THE WTO AND THE EU RULES REGARDING STATE AID AND SUBSIDIES TO UNDERTAKINGS

Abstract
The article considers fundamental approaches of the WTO norms on subsidies and EU state aid rules. Basic features of the notions of ‘subsidy’ and ‘state aid to undertakings’ were analyzed. The article examines criteria of existence of specific subsidies and state aid: involvement of the state and state resources, selectivity (specificity), benefit (advantage). Common features and differences in formulation and interpretation of these criteria were mentioned, in the WTO and EU rules. The article therefore formulated an evidence of state intervention, which impacts competition and international trade, as well as measures of general character that are not subject of application of the mentioned rules.
