CONCEPT OF THE CONTRACT OF SALE AND PURCHASE OF PROPERTY RIGHTS ON REAL ESTATE

Abstract
In the article the concept of the contract of sale and purchase of property rights of residential and non-residential real estate, which will be built in the future are analyzed. The regulatory and legal framework, which is the basis for this type of contract, is analyzed in detail. The author notes that the most correct is using of the term “contract of sale and purchase of property rights on real estate” for these types of contracts. Other versions of the names of this type of contract are criticized. Particular attention paid to the legal nature of property rights on real estate. The conclusion about the legal essence of property rights to construction objects, which not fully explored, because they contain in themselves both attributes of real rights and limited proprietary rights is done.
