Conscience clause in professions of a doctor, a nurse and a midwife in the light of new legal regulations

Abstract

Introduction. The article presents the legal aspects associated with the “Conscience clause” in professions of a doctor, a nurse and a midwife. The use of the conscience clause for these professional groups is determined by the applicable regulations. Aim. Presentation of the existing legal and deontological regulations relating to conscience clause in the medical, nursing and midwives profession. Material. The analysis of legal acts and literature sources. Conclusions. Conscience clause is not a fully effective solution to the problem arising between medical personnel and the patient. In practice, it is known that it is not always an ideal solution in the event of conflict between medical staff and patients, and in certain circumstances, it may become even the litigation.
