CONSTITUTIONAL PROCESS AND CRISIS PHENOMENA IN THE PRESENT POLITICAL LIFE OF UKRAINE

Abstract

The article deals with interrelation of contradictory elements of the current Constitution of Ukraine under circumstances of acute manifestations of political struggle in modern Ukrainian society. An insufficient level of critical perception of the current provisions of the Constitution of Ukraine by modern scientists and current politicians has been noted. A number of key provisions of the Basic Law of Ukraine and the existing practice of their implementation in practical politics have been analyzed. The author focuses on the provisions of the Constitution of Ukraine, which cause problems of interaction within branches of power in Ukraine and its provisions that determine the relationship between leading political institutions – the President, the Par-liament and the Cabinet of Ministers. It is asserted that the existence of a super-presidential republic in modern Ukraine is a signifi-cant obstacle to the functioning of a political system on a democratic basis and the provision of an effective system of checks and balances. The presence of several dangerous contradictions in the very mechanism of the supreme executive authority formation is noted as a factor that complicates both the procedure of the government formation and the process of its governing. The existing contradictions of the provisions of the Constitution of Ukraine and existing laws are considered as the basic factors of the crisis phenomena development in the modern political process. The author emphasizes the importance of achieving the state‟s ability to realize constitutional rights to self-government and de-velopment of civil organizations. This is what makes it possible to provide a foundation for keeping the balance of interests between different social strata. The necessity to improve constitutional norms is considered as one of the most important area for political relations optimization in order to overcome the threats of destructive consequences of political struggle for the State and Ukrainian society.
