CONTENT AND LEGAL NATURE OF THE JURIDICAL DISPUTE

Abstract
The article analyzes the approaches to understanding the content of the “dispute about the right” as a legal category existing in the science of civil procedural law, the correlation of the “dispute about the right” with the “legal dispute”. The author proves that these notions and “juridical disputes” should be considered as synonyms. The juridical dispute should be understood as a legal deviation which is rewarded as a result of the appearance of legal uncertainty in the subjective rights and obligations of several entities. Inherently the juridical dispute is always pre-procedural or out-procedural phenomenon with substantive nature.
