CONTROVERSY OVER THE MOMENT OF MANDATE EXPIRY OF A BOROUGH LEADER DISMISSED BY MEANS OF REFERENDUM – OPINION IN A DISCUSSION

Abstract

Dismissing a borough leader by means of referendum is a prerequisite for the expiry of a borough leader’s mandate in accordance with article 492 § 1 point 8 of the Elections Code. As regards this prerequisite (contrary to many others) the legislator does not require any appropriate act to be adopted confirming legal consequences that has already arisen. This being the case it seems that a borough leader’s mandate should expire by force of law upon the dismissal itself with the possibility to cite the circumstances immediately. Meanwhile, in article 67 paragraph 2 of the act on local referendum the legislator points out it is only the announcement of the results of the referendum held upon the request of inhabitants, under article 63 paragraph 2, decisive on the dismissal of administrative district bodies (that is, among others a borough leader) before the end of the term of office, which means the termination of the activity of these bodies. In this study the author thoroughly analyses the issues connected with establishing at which moment in actual fact the expiry takes place. Unfortunately, imprecise and containing loopholes in the law provisions cause the situation in which extremely different opinions are presented in literature.<br/><br/>
