CRIME OF MIGRANTS IN UKRAINE: DETERMINATION AND PREVENTION

Abstract

The article is devoted to the research of the problem of the crime of migrants in Ukraine, the reasons for its occurrence and some preventive approaches. The author proposes to understand the crime of migrants as complex of crimes, covered by the law on criminal liability, committed in a certain time interval and in a certain territory by persons who, in accordance with the international legal acts and the national legislation are recognized as migrants. It is determined that the determination of the modern Ukrainian structure of migrants’ crime is characterized by the mass migration, including an increase in the number of internally displaced persons (due to the illegal annexation of the Autonomous Republic of Crimea by Russia and acts of aggression in the eastern territories of Ukraine), as well as the absence of a clear accounting system and registration of migrants in the State. Cultural incompatibility of ethnic groups at different levels of social and socio-cultural development also serves as one of the important factors contributing to the reproduction of tort in the modern society. In many cases, the mismatch of value policies becomes one of the reasons why migrants who are foreigners commit offenses and crimes in the territory of receiving States. Among the measures of crime prevention of migrants are determined: the creation of preconditions to exclude the possibility of existence of crime of migrants and elimination of the problems associated with the stay of migrants in the host society; migration amnesty; special-criminological measures focused on the system of determinants of crimes committed by migrants in order to reduce their influence or complete elimination, including comprehensive automation of the accounting and registration of migrants; the resolution of some problems of criminal liability of foreigners and stateless persons, the imposition of penalties and release from liability to prevent cases of further settling of previously convicted foreigners and the criminal recidivism of migrants in the State.
