Criminal legal characteristic of medical error

Abstract
The article analyzes the norms of current legislation, justified the conclusion about the need to improve the legal regulation of criminal law protection of the rights and legitimate interests of the patient. The author substantiated the expediency of overcoming the existing problems of the legal regulation of patient rights. The author identified the medical error as an objectively wrongful adverse result due to objective and subjective factors. Medical errors can be classified into: 1) medical errors resulting from objective reasons; 2) medical errors caused by subjective reasons. The expediency of establishing a list of consequences that can be identified as significant harm to health is emphasized.
