CRIMINAL LEGAL CHARACTERISTICS OF SOCIALLY DANGEROUS CONSEQUENCES OF NEGLIGENCE JUDICIAL DECISION

Abstract
The article examines the issues of criminal-law qualification for intentional non-enforcement of a court decision that caused significant damage to the rights and freedoms of citizens protected by law, public or public interests or the inter- ests of legal persons. Taking into account the analysis of judicial practice, the criteria for specifying the estimated socially dangerous consequences of a deliberate non-execution of a court decision in the form of substantial damage to the rights and freedoms of citizens, public or public interests or interests of legal entities are protected by law. The definition of the mentioned concept for the purposes of criminal-legal qualification is offered in accordance with Part 3 of Art. 382 of the Criminal Code of Ukraine.
