Criminal liability of legal entities according to the legislation of Ukraine and of the Republic of Moldova

Abstract

The article investigates the peculiarities of the legal persons’ quasi-criminal liability, consisting in applying to them measures of a criminal nature, under the criminal law of Ukraine and the criminal liability of legal persons in accordance with the criminal law of the Republic of Moldova. The author concluded that the quasi-criminal nature of the legal persons’ liability under the Criminal Code of Ukraine makes difficult the application to them of measures having a criminal law character, as it provides for a single criminal procedure regarding the person authorized to bring criminal liability and the legal person to whom the measures are applied under the criminal law. For these reasons, the author formulates amendment proposals for the Criminal Code of Ukraine.
