Current Trends in Arbitration in Austria

Abstract

The Vienna Rules 2013 offer new features and ensure that arbitral proceedings remain flexible, expeditious and fair, thus responding to the needs of international users. Especially the new rules on multi-party proceedings perfectly balance the practical need to include third persons in pending arbitral proceedings while safeguarding the parties’ rights and interests in a speedy and efficient decision. The 2013 amendment of the Austrian Arbitration Act 2006 introducing the Supreme Court as first and only instance in setting-aside proceedings is an important development to further increase the attractiveness of Austria as a place for international arbitration. As the Austrian arbitration community is very active in further developing and promoting Austria as place for international arbitrations, additional adjustments of the Austrian arbitration law to the needs of the international arbitration community may hopefully be expected in the near future .
