DECISION OF THE EUROPEAN COURT OF HUMAN RIGHTS AS THE LEGAL REGULATOR OF RELATIONS WITH THE ALIENATION OF PRIVATE PROPERTY FOR PUBLIC NEEDS OR FOR REASONS OF PUBLIC NECESSITY

Abstract
The article examined the decisions of The European Court of Human Rights as a legal regulator of relations on alienation of private property for public needs or based on motives of social necessity. The criteria for classifying the decisions of the European Court of Human Rights in the field under investigation are determined. Standards have been established for regulating the relations of alienation of private property for public needs or based on the motives of social necessity contained in the decisions of the European Court of Human Rights. The value of decisions of the European Court of Human Rights as sources of law has been determined.
