ДЕТЕРМІНАЦІЯ ЗЛОЧИНІВ У СФЕРІ ВИГОТОВЛЕННЯ Й ОБІГУ ЛІКАРСЬКИХ ЗАСОБІВ

Abstract
In the scientific article criminogenic determinants contributing to crimes in the field of manufacturing and circulation of medicines are investigated. The criminogenic determinants are structured: on normative-legal, organizational-managerial, socio-economic and cultural-educational. Particular attention is paid to the consideration of the reasons for the low rates of detection by counterfeit medicines and circulation (including import) of counterfeit medicines by state controllers and law enforcement agencies. The following problems in the pharmaceutical industry are highlighted, which contribute to crimes in this area, such as poor protection of intellectual property, inadequate state regulation and control over the activities of business entities that produce and market pharmaceuticals in the pharmaceutical market, until recently, a moratorium on inspections of pharmaceutical companies, frequent changes in the organization and structure of regulatory institutions in the pharmaceutical sector, duplication of control. In particular, it turned out that the problem of medicines falsification was complicated in Ukraine when a moratorium on inspections in the pharmaceutical sector was in effect. It was found that during the period of the moratorium it was almost impossible to detect a falsification in the pharmaceutical market, since unscrupulous business entities had the opportunity to hide all problem medicines. The article also proves the feasibility of amending the current legislation to provide the state quality control authority of medicines with the possibility of conducting inspections without the need for notification of business entities within 10 days prior to their conducting. It is emphasized that the presence of such restrictions makes it difficult to detect counterfeit medicines by the controlling bodies. In addition, on the basis of systematization of criminogenic determinants that facilitate the commission of crimes in the sphere of manufacturing and circulation of medicines, the following problem was highlighted as insufficient level of training of operational officers of the National Police of Ukraine capable of conducting work on timely detection and documentation of criminal activity of business entities , which carry out illegal actions on the distribution on the pharmaceutical market of counterfeit medicines.
