ПРАВОВЕ РЕГУЛЮВАННЯ НОТАРІАЛЬНОЇ ДІЯЛЬНОСТІ НА ЗАХІДНОУКРАЇНСЬКИХ ЗЕМЛЯХ У СКЛАДІ ПОЛЬЩІ (1921–1939 РР.)

Abstract

The article examines the legal field in which the notary activity was carried out on the western Ukrainian lands as a part of Poland during the interwar period. The empirical basis of the research constitutes the works of researchers in the field of the history of the state and the law of Ukraine, the history of civil and notarial law and the notarial process, normative legal acts of the relevant branches of law, documents and materials of funds of the Central State Historical Archives of Ukraine are published and revealed. On the basis of the analysis of normative documents, it is pointed out that the development of the Ukrainian notary in the second half of the nineteenth and early twentieth centuries on the western Ukrainian lands under Austro-Hungarian, Polish, Romanian authorities corresponded to the legislation of these states, reflecting the western tradition of law, in particular notarial. Legal regulation of notary activities in the West Ukrainian lands, which were part of the Austro-Hungarian monarchy, was carried out mainly by the Notary Order of 1871, according to which the notary was subject to the corporation, while not separating from the judicial authorities (that is, it corresponded to the European (Latin) model). This procedure acted on the territory of Galicia even after the collapse of Austria-Hungary: both in the Western Ukrainian People's Republic and after the transfer in 1923 of Galicia to Poland - by July 1, 1934. Further questions of the notary were regulated by the "Law on Notary", which launched a new stage in the history of both Polish notaries and notaries on the western Ukrainian lands under the jurisdiction of Poland. Notaries have been recognized as highly educated and highly qualified independent lawyers with the right of professional association.
