ЮРИДИЧНА ПРИРОДА НЕТИПОВИХ ПРАВОВИХ ПРИПИСІВ

Abstract

In the scientific article the phenomenon of atypical legal prescriptions in the mechanism of legal regulation is investigated. The problems of theory and practice of application of the norm of law and legal prescriptions are analyzed, an analysis of the position of scientists about their types is carried out. Also, the article considers the internal structure of legal regulations. An analysis of the positions of scientists regarding the essence of atypical legal requirements is carried out. Аtypical legal requirements should be separated from the rules of law. In modern legal doctrine, atypical legal prescriptions are interpreted mainly through the prism of the atypical element of the system of law. An attitude is expressed mainly in the fact that they are deprived of the traditional logic of the rule of law, by virtue of which they appear compositionally imperfect, structurally incomplete. Аtypical legal prescriptions regarding the norm of law and the system of law are of subsidiary nature, they serve as the circumstances contributing to the composition of the law, and also connects all its elements to a single integrity. The character of the relationship and interaction of the atypical legal prescriptions with the legal technique is determined. The conclusions are drawn that the norm of law and legal prescription interact as content and form, whole and part. Unusual regulatory requirements are extremely numerous in nature and content, and they are also diverse in purpose. In the process of considering the legal nature of atypical legal prescriptions, a special place is the stage of isolation and systematization of the latter. The position that the problem of classification of atypical legal prescriptions remains unresolved to the end is characterized. To date, in domestic law there is no single classification of atypical legal prescriptions. In general, the operation of atypical legal regulations provides a general predictability of the mechanism of legal regulation of the legal system, and therefore promotes the freedom of action of subjects of law.
