ОРГАНІЗАЦІЯ ЗАБЕЗПЕЧЕННЯ ГРОМАДСЬКОГО ПОРЯДКУ ОРГАНАМИ МІСЦЕВОГО САМОВРЯДУВАННЯ В ЄС: ВИВЧЕННЯ ПОЗИТИВНОГО ДОСВІДУ

Abstract

The article notes that one of the main tasks of reforming local self-government and the territorial organization of power in Ukraine is the creation of safe conditions for the life of people and society. The example of Poland analyzes the results of the reform of local self-government in Eastern European countries. We study the positive experience of a radical transformation of the public sector, in particular, significant changes in the field of public order and security at the level of local communities. This will make it possible to formulate the organizational and legal framework for the activities of the municipal guard in Ukraine, as well as to develop a mechanism for the transition to decentralized forms of public order protection. The main tasks of the municipal guard are determined. Patrolling the community does not punish the public by imposing fines. The purpose of their activity is to control the state of public behavior, to prevent violations of public order, as well as to intervene if necessary. If officials of the municipal guards call to intervene, they act directly in the specific situation of the offense. Municipal guards should also provide effective assistance to people who need it or find themselves in a difficult situation. Regarding each person in respect of whom the offense was committed, the guard takes the initiative. Each employee of the municipal guard must strive to increase its prestige and take care of security and at the same time social trust. Society expects the guard to initiate professional actions in the field of order. The municipal guard carries out the tasks of society to ensure order and security on the basis of rules, laws and acts of local law. It is determined that the legal basis for the activities of the municipal guard in Poland at the state level is a special legislative act, and at the local level – the charter of the municipal guard. It is noted that in order to regulate the activities of similar units in Ukraine, it is necessary to adopt the Law of Ukraine “On Municipal Guard”, given the positive experience of the functioning of the municipal guard in Poland.
