DEVELOPMENT OF LEGAL WARRANTY OF PERSONS WITH DISABILITIES IN EMPLOYMENT

Abstract

The article is devoted special characteristic of the employment relationship – persons with disabilities, and basic legal safeguards to ensure their working conditions. It is noted that the content of the right to work is revealed in the following aspects: applies to all people without exception, subject to the requirements established for the exercise of employment law; is a free choice of individuals in what should be understood consolidate the principle of comprehensive labor law – freedom of labor; guaranteed by the state. Characterized duties of enterprises, institutions, organizations and individuals that use hired labor, to create jobs for the disabled, including special jobs, creating conditions for them based on individual rehabilitation programs, provision of other social and economic guarantees required by law. Emphasized the fact that, along with state guarantees employment to disabled preschool education, education at a level appropriate to their abilities and capabilities, carried out in schools. In teaching, training or retraining of disabled allowed alternative forms of education. In turn, gifted children with disabilities are entitled to free teaching music, art and crafts in schools. The conclusions that are unacceptable perception of disability as a personal human pathology; consideration of the limited capacity of the individual in the context of the relationship between the individual and his illness. Thus, to change the situation must not only create an effective system of employment of the disabled, but also to develop a single regulation that would regulate the rights of the disabled in employment, procedure of their employment and the legal status of employers.
