DISCUSSION QUESTIONS REGARDING THE RECOGNITION OF “REASONABLE SUSPICION” AS THE BASIS FOR THE APPLICATION OF PREVENTIVE MEASURES

Abstract
The author of the article has studied the essence of the legal and factual grounds for the application of preventive measures. It has been proved that the presence of the reasonable suspicion is not a reason for the application of pre- ventive measures. It has been established that suspicion report should be considered not as a basis for the application of preventive measures, but as a necessary condition in the presence of which in criminal proceedings the right to choose a certain type of preventive measure is generated and the subject for which it can be applied is determined.
