Abstract
In the article, based on the analysis of scientific views of scientists and international legal acts, the international standards for the introduction of the mediation institute in Ukraine, which were established by the Council of Europe, were considered. It is substantiated that one of the most important problems of the full implementation of the mediation institution in Ukraine is the lack of a legislative basis for its functioning, that is its legal basis.
