Abstract
The subject-matter of this article is the effectiveness of linguistic rights. The purpose of this study, based on reflections on the interdisciplinary field of Language Policy, is to analyze judicial decisions and discuss the language policy orientations that influence or even determine the outcome of the judgements, as well as the occurrence of violation of linguistic rights and disregard for linguistic plurality. In order to proceed with the discussion, the study was carried out through bibliographical and electronic research, from which considerations on Brazilian language diversity and its language policies are made. The analyzes and reflections reiterate the importance and the need for discussions on language management actions in the need for discussions on language management actions in the legal domain, considering that in many cases, although there is a whole set of international and national language laws and regulations on the subject, the issue of language rights is not appropriately considered.
