Electronic Commerce Contraction in the Laws of Iran

Abstract

This study investigates the electronic commerce contraction in the law of Iran by using a descriptive method and comparative trend. The result of this study shows that making a contraction in a virtual environment is generally the same as making a contraction in real world. Based on the ratification and parties assurances and in this regard there is no difference between these two environments. Essentially, the usage of electronic contractions is based on the information system and the data exchange of the message which composes this information or the content of the exchangeable electronic product .The potential electronic contraction is considered as a written contraction and the electronic signature is considered as the basis of willingness expression validity in valid electronic contractions.
