ENSURING THE RIGHT TO EFFECTIVE PROTECTION AS A BASIS FOR CRIMINAL PROCEEDINGS IN NATIONAL LAW AND PRACTICE OF THE EUROPEAN COURT OF HUMAN RIGHTS

Abstract
The article considers such a principle of criminal proceedings as securing the suspect, accused with the right to defense. The content of this principle is determined from the point of view of the modern criminal procedural legislation of Ukraine. Specific features of the application of this principle in the practice of the European Court of Human Rights are established. Is formulated the proposal on the legal regulation of the category of "effective protection" in the acting CPC of Ukraine
