Ensuring the right to life of a conceived, but not born yet child

Abstract

The author believes that legal capacity (in substantive law) arises from the moment of conception, and therefore upholds the position that the law should protect the rights of children even before their birth, including the right to life. The article also discusses recent developments in the legalization of “postnatal abortions” in some states in the United States, on the basis of which the author concludes that the rhetoric on the admissibility of abortions goes to another plane and goes far beyond the arguments that were previously cited by supporters of abortions in defense of their acceptability. The article substantiates that the problem of artificially terminating pregnancy should be solved not so much at the level of the law, as at the level of morality, culture and public consciousness through educational activities and social programs, as well as through the sharing with the women of the burden of responsibility for parenting and providing children, who were conceived and subsequently born not preferably.
