Abstract
The article analyses contemporary issues of aggravated elements of crime provided for by Article 376 of the Criminal Code of Ukraine and Article 232 of the Criminal Code of the Republic of Poland. The authors have analyzed criminal legislation of the Republic of Poland with the aim of borrowing positive experience while forming aggravated and especially aggravated elements of crime.
