Freedom of expression on the Internet: pro et contra

Abstract
Problem setting. In this article author analyses issues of the freedom of speech, freedom of expression and freedom of information in the Internet, and also restrictions of the fundamental constitutional freedoms, enshrined Article 34 of the Constitution of Ukraine and the category “informational security”. In the Internet we can to express our opinion in any way, including orally and in writing (freedom of speech), and also by the conclusive actions (for example, “like” some posts), but these possibilities are limited. That’s why we can call freedom of speech “the heart” of the freedom of expression. Target of research. Ukrainians legislation should secure a clear list of restrictions on freedom of expression. Thus we propose to exclude from the list of restrictions category of “the necessity to protect public morals”, to liquidate the National Expert Commission on public morality protection and by law fix a clear definition of "information security" and possibility of its use. Article’s main body. Users of the network as a part of civil society and public authorities should use the opportunities provided by the Constitution of Ukraine integral and inalienable such fundamental constitutional rights and freedoms, such as freedom of speech, freedom of expression and freedom of information. Also, public education efforts and influence, and public policy should be directed at eliminating tendencies leveling values of constitutional rights and freedoms, the transformation of legal awareness of the people towards the perception of the norm effective use of fundamental rights and freedoms. Conclusions and prospects for the development. So, Ukrainians need to achieve harmonization of regulations with the Constitution of Ukraine and the specific actions of state bodies with current national legislation, because the rule enshrined Part 2 of Article 19 of the Basic Law expressly provides that public authorities, local government bodies and their officials are required to act only on the grounds and within the limits and in the manner envisaged by the Constitution and laws of Ukraine.
