General theoretical concept of judicial lawmaking

Abstract
The article investigates general theoretical concept of judicial law-making that characterize the judicial lawmaking as a special kind of lawmaking. Distinguishes the following concepts: knowledge of reality, the active nature of justice, truth judicial rights dual nature of law-making, judicial or court of law, judicial activism. It turns out the legal nature of judicial law-making based on general theoretical concepts.
