GIVING IN PAYMENT AS A GROUND OF EXTINCTION OF AN OBLIGATION IN THE LAW OF ANCIENT ROME

Abstract
The article is devoted to giving in payment in the law of Ancient Rome. The legal nature of giving in payment is ascertained. The approaches of ancient roman jurists concerning the legal consequences of giving in payment are analyzed. Particularly the discussion between Proculians and Sabinians regarding the question if giving in payment terminates the obligation by operation of law or it merely gives an exception to the defendant against the action of plaintiff.
