Громадські консультації як форма демократії участі в зарубіжних країнах

Abstract
At the present stage one of priority directions of the national constitutional reform is the development of mechanisms of the participatory democracy (participatory democracy or public participation), the lack of which hinders the reform of the territorial organization of the power in Ukraine. In foreign countries there is the broader approach to the application of organizational forms of the public participation in the local government, including not only local elections, referendums, citizens' meetings, but also public consultations. Problems of the improvement of constitutional guarantees of the participative democracy to fully and comprehensively discovered in publications I. Bodrova, P. Lubchenco, A. Lyalyuk, S. Seregina and others. At the same time, the foreign practice of public consultations in the Ukrainian legal science has not been sufficiently studied. The purpose of the article is an overview international standards for carry out public consultations, determining features of the legal basis public consultations in foreign countries and identify the role of this form of the participative democracy in the development of the local self-government. The international standard in the field of the public administration is the principle of citizen’s participation in the decision-making process through various institutions of the participatory democracy. Today the Council of Europe and the European Union have developed a number of conceptual foundations for carry out public consultations at the national level. In the vast majority of foreign countries organizational and legal mechanisms of public consultations are fixed at the level of current legislation and acts of local self-government bodies. The current trend in the development of the legal basis for public consultations is the practice of defining forms and methods of these public discussions in the documents called "codes", "standards", "guidelines", which are obligatory. At present the form of on-line public consultations, which is being introduced through e-governance projects, is becoming popular in foreign countries. In the field of the local self-government public consultations provide opportunities for the population to express their views on the concrete document or event, to take direct part in the development of municipal programs and provide feedback between the local government and the community. In the process of improving of national forms of the participation democracy should be attention to the practice of public consultations in Australia, where citizens are actively involved in discussing the financial basis of the municipality.
