HOW TO INVOKE NULLITY – COMPARATIVE ASPECTS BETWEEN THE CIVIL PROCEDURAL LAW OF THE REPUBLIC OF MOLDOVA AND OF ROMANIA

Abstract
The nullity produces serious legal effects for the holder of the subjective right as to legal relations, so that once invoked and applied, it leads namely to invalidation of the civil procedural act, thus it is not existing anymore for the benefit of its author and, as a consequence, it cannot be protected anymore through a legal action or, as the case may be, through defense on merits of a certain procedural right. Therefore, the importance of acknowledging this legal institution is uncontestable, reason for which this research tried to gradually deepen the subject of invoking nullity based on the procedural law of the Republic of Moldova and Romania.
