হুদহুদ-এর অপরাধ ও সুলাইমান আ. কর্তৃক ঘোষিত শাস্তি : প্রচলিত ও ইসলামী আইনের দৃষ্টিতে একটি পর্যালোচনা|Offence of Hoopoe and the Punishment Pronounced by Solomon A. : A Critical Analysis from the Perspective of Conventional and Islamic Law

Abstract
Prophet Sulayman ibn Dawud (PBUH) was endowed with wisdom, farsightedness and state power by Allah (SWT). Even he was bestowed by Him with the distinctive ability to speak to animals and jinn. Amidst the different narratives of the Qur’an the trial of hud-hud in absentia bears crucial significance. This article intends to critically analyze the significant aspects of that trial in the light of conventional and Islamic Law. Exploiting the descriptive and analytical method of research the author has drawn four important principles from the trial of hud-hud conducted by Prophet Sulayman (PBUH) namely, negligence to duty is punishable offence, conducting trial in absentia is lawful, permission to the defendant to plead self-defense and acquittal of the defendant for showing justifiable causes against complaint. The aforesaid principles are equally endorsed by conventional as well as Islamic Law. সুলাইমান আ. ছিলেন মহান আল্লাহর একজন প্রসিদ্ধ নবী। তিনি ছিলেন দাঊদ আ.-এর পুত্র। মহান আল্লাহ তাকে জ্ঞান, প্রজ্ঞা ও নবুওয়াতের মর্যাদায় সমৃদ্ধ করেন। সাথে সাথে তাঁকে এমন রাষ্ট্রক্ষমতা প্রদান করেন, যার প্রভাব জ্বিন, পশুপাখি সবকিছুর ওপর ছিল। পবিত্র কুরআনে তাঁর জীবনের যেসব বিষয় উল্লেখ করা হয়েছে তার মধ্যে হুদহুদের অনুপস্থিতিতে তার বিরুদ্ধে বিচারিক ফরমান জারি সংক্রান্ত বিষয়টি অন্যতম। এ ঘটনা থেকে যেসব গুরুত্বপূর্ণ দিক ফুটে ওঠেছে, প্রচলিত ও ইসলামী আইনের দৃষ্টিতে সেগুলো পর্যালোচনার উদ্দেশ্যে এ প্রবন্ধটি প্রণীত হয়েছে। বর্ণনা ও পর্যালোচনামূলক পদ্ধতিতে রচিত এ প্রবন্ধ থেকে প্রমাণিত হয়েছে, হুদহুদের অনুপস্থিতিতে কৃত বিচার থেকে যে চারটি গুরুত্বপূর্ণ বিষয় সাব্যস্ত হয়েছে সেগুলো অর্থাৎ দায়িত্বে অবহেলা শাস্তিযোগ্য অপরাধ, বিশেষ বিশেষ অবস্থায় অপরাধীর অনুপস্থিতিতে বিচার বৈধ, বিবাদীকে আত্মপক্ষ সমর্থনের সুযোগ দেয়া, অভিযোগের যথাযথ কারণ দর্শালে তাকে অভিযোগ থেকে অব্যাহতি দেয়া ইসলামী ও প্রচলিত আইনেও অনুমোদিত।
