ইসলামী ফাইন্যান্সে মাকাসিদ আশ শারীআহ-এর প্রয়োগ: একটি পর্যালোচনা|Applications of Maqāsid al-Sharīʻah in Islamic Finance An Analysis

Abstract
Considering the indispensability of wealth in human life, Islam instead of negating puts special emphasis on wealth. Even preservation of wealth is regarded as one of the maqāsid al Sharīʻah (objectives of Sharīʻah) in Islam. To guide human being in this regard, Islam has prescribed as well as proscribed necessary injunctions. This paper aims to shed light on three crucial sectors pertaining to Islamic Finance namely Islamic Banking, Islamic Capital Market and Takaful (Insurance) in the light of maqāsid al Sharīʻah. The author painstakingly endeavors to prove that Islamic jurists, in delineating maqāsid al Sharīʻah regarding property, has intensely explicated the issues of acquisition, investment, mobilization and expenditure of property with special emphasis on justice, transparency, proscription against illegal grabbing etc. He advances the argument that proper compliance with the principles of Islamic Finance inevitably ensures the realization of both specific and general maqāsid al Sharīʻah. Moreover, the paper splendidly spells out that edicts of Islamic Finance encompass the dynamism to warrant mobility in investment and mobilization of Sharīʻah permitted property, ensure justice and fair distribution of property, sweep away illegal grabbing, preserve property and improve the faith and character of concerned persons. মানব জীবনে ধন-সম্পদের প্রয়োজনীয়তা অনস্বীকার্য। এ কারণে ইসলাম ধনসম্পদের ব্যাপারে গুরুত্ব প্রদান করেছে এবং এর সাথে ঈমান ও আখলাকের সম্পর্ক জুড়ে দিয়েছে। ইসলামী বিধি-বিধানের মৌলিক উদ্দেশ্যসমূহের (মাকাসিদুশ শারীআহ) মধ্যে ‘ধন-সম্পদ সংরক্ষণ’ অন্যতম উদ্দেশ্য। কতিপয় বিধিনিষেধ জারির মাধ্যমে উক্ত উদ্দেশ্য বাস্তবায়ন নিশ্চিত করা হয়েছে। ইসলামী ফাইন্যান্সে মাকাসিদের প্রায়োগিক পর্যালোচনা নিয়ে বক্ষ্যমাণ প্রবন্ধের প্রয়াস। অত্র প্রবন্ধে বর্ণনামূলক পদ্ধতিতে ইসলামী ফাইন্যান্সের উল্লেখযোগ্য তিনটি ক্ষেত্র তথা ইসলামী ব্যাংকিং, ইসলামিক ক্যাপিটাল মার্কেট এবং তাকাফুল সংশ্লিষ্ট গুরুত্বপূর্ণ কতিপয় কার্যক্রম মাকাসিদুশ শরীআহর আলোকে বিশ্লেষণ করা হয়েছে। প্রবন্ধ থেকে প্রমাণিত হয়েছে, মুসলিম স্কলারগণ সাধারণত আর্থিক লেনদেনের ক্ষেত্রে শারীআহর মাকাসিদ হিসেবে সম্পদের উপার্জন ও বিনিয়োগ, আবর্তন, সুবিচার, স্বচ্ছতা, অন্যায় আগ্রাসন থেকে সুরক্ষা ইত্যাদি উল্লেখ করেছেন। ইসলামী ফাইন্যান্সের মাধ্যমে সংশ্লিষ্ট বিশেষ মাকাসিদ (المقاصد الخاصة) অর্জনের পাশাপাশি সামগ্রিকভাবে আর্থিক লেনদেনের মৌলিক মাকাসিদ (المقاصد العامة)ও বাস্তবায়িত হয়ে থাকে। ইসলামী ফাইন্যান্স শারীআহ অনুমোদিত সম্পদের বিনিয়োগ ও আবর্তনে গতিশীলতা আনে, সুবিচার ও সুষম বণ্টন নিশ্চিত করে, অন্যায় আগ্রাসন দূর করে, সম্পদ সুরক্ষা করে এবং সর্বশেষে ব্যক্তির ঈমান ও আখলাকের উন্নয়ন সাধন করে।
