Humanitarian Law in Islam

Abstract
As one of the most important branches of Law, International Humanitarian Rights tries to restrain an armed conflict as much as possible - in case, despite preventive action, it happens - to decrease its destructive effects and to make it submissive to the regulations. To explain the views of religions particularly those of Islam as one of the most important religions in the contemporary world - which unfortunately sometimes is misunderstood and misinterpreted by even its followers - is of crucial significance. Referring to the Quranic verses and Islamic traditions this article tries to introduce Islamic views on the rules and regulations governing the parties’ relations before and after an armed conflict. چکیده حقوق بشردوستانه بینالمللی یکی از مهمترین شاخههای دانش گسترده حقوق است که کوشش دارد اگر به رغم تلاشهای پیشگیرانه، مخاصمه مسلحانهای آغاز شد، آنرا هر چه محدودتر سازد، از آثار مخربش بکاهد و تابع مقررات کند. تبیین دیدگاههای ادیان، به ویژه اسلام به عنوان یکی از مهمترین ادیان جهان معاصر، که متأسفانه گاه حتی از سوی پیروانش مورد کجفهمی و سوء تفسیر قرار گرفته، اهمیت ویژهای دارد. مقالة حاضر تلاشی است در این جهت و با استناد به آیات و روایات، دیدگاههای اسلامی درباره قواعد و مقررات حاکم بر روابط طرفین، پیش و پس از مخاصمات مسلحانه را ارائه میکند. به چند فرهنگگروی بسیار محدود باقی مانده است. معمولاً نهادهای ناظر بر معاهدات حقوق بشر و محاکم بینالمللی و منطقهای برای استفاده از این واژه علاقهای نشان نمیدهند. یکی از دلائل آن میتواند فقدان یک تعریف حقوقی دقیق باشد. این مقاله قصد دارد موارد ذیل را بررسی نماید: چگونه نظام حقوق بشر از چند فرهنگگروی حمایت میکند، گرچه هیچگاه اشارة خاصی به آن نمینماید؛ مشکل تعریفی و اینکه چگونه مفهوم تکثرگرایی حقوقی بر چند فرهنگگروی ارجحیت مییابد؛ فایده به رسمیت شناختن چند فرهنگگروی از یک منظر حقوقی
