The Children’s Right to Social Identity and Its Relationship to the Parents’ Prior Right to Choose the Kind of Education and Training Given to Their Children

Abstract

The fact that the parents enjoy some sort of freedom and prior right to choose the kind of their children’s education and training is in general accepted by religious texts as well as national and international laws and procedures. The main question raised by this article is that in case the parents or other lawful guardians of children including children of minorities, consciously or otherwise abuse this right –e.g. choose a way disordering the children’s social identity development process - how could this situation be reformed? This article tries to make it clear that based on the Islamic jurisprudence and legal analysis as well as some legal stipulations, the above-mentioned prior right of parents is not absolute and is limited to the best interest of the children. It is necessary, however, for the law-makers to act more actively making more comprehensive and more explicit laws to secure the children’s rights. چکیده این موضوع ‌که والدین در انتخاب نوع تربیت و آموزش کودکان خود نوعی آزادی عمل دارند و نسبت به دیگران از حق تقدم برخوردارند، موضوعی است که اجمالاً در متون دینی، قوانین و رویه‌های ملی و بین‌المللی پذیرفته شده است. پرسش اصلی این نوشتار این است که اگر والدین یا دیگر اولیای قانونی کودکان، از جمله کودکان مربوط به اقلیت‌ها، خواسته یا ناخواسته از این حق سوء استفاده کنند و مثلاً شیوه‌ای در تربیت کودکان خویش برگزینند که روند هویت‌یابی آنان را مختل کند، چه راهکارهایی برای اصلاح این وضعیت می‌توان در نظر گرفت؟ این نوشتار در صدد است تا مشخص ‌کند که بر اساس آموزه‌های فقهی و تحلیل‌های حقوقی و نیز تصریح پاره‌ای قوانین، حق اولویت والدین در انتخاب نوع و میزان آموزش کودکانشان، حقی مطلق نبوده و به غبطه و منافع عالیه کودکان منوط و محدود است؛ اما نظر به اهمیت فوق‌العاده موضوع، ضروری است قانونگذار برخورد فعال‌تری با مسئله نموده و مقررات صریح‌تر و جامع‌تری برای تضمین حقوق کودکان وضع کند. و آثار حقوقی و اجتماعی آنها بررسی خواهد شد.
