IMPLEMENTASI TERHADAP PEMBERIAN UANG KOMPENSASI BAGI KARYAWAN PKWT

Abstract
Era globalisasi ini dimana perekonomian semakian maju pesat sehingga banyak pesaing-pesaing bermunculan di bidang perekonomian, untuk menciptakan iklim yang kondusif baik dari sisi perekonomian, perijinan dan ketenagakerjaan maka pemerintah menciptakan suatu aturan yaitu Undang-undang Omnibus Law yang mempunyai tujuan untuk menciptakan iklim usaha dan investasi yang berkualitas bagi para pelaku bisnis, termasuk UMKM dan investor asing. Dalam bidang Ketenagakerjaan Pemerintah menerbitkan UU No. 11 Tahun 2020 dan PP No. 35 Tahun 2021 dengan tujuan untuk memberikan perlindungan hukum dan mensejahterakan bagi pekerja, namun pada penelitian ini perlu dilakukan pengkajian karena terdapat penghapusan, pembaruan, dan penyisipan pasal mengenai hukum ketenagakerjaan. Di antara pembaruan aturan tersebut, yang dibahas dalam penelitian ini adalah analisis aturan Perjanjian Kerja Waktu Tertentu (PKWT) dalam UU Cipta Kerja. Terdapat perubahan dalam aturan PKWT yaitu pekerja/buruh yang masa kontraknya telah berakhir, berhak menerima uang kompensasi . Hal itu merupakan hal yang baru, sehinga tujuan penelitian ini adalah untuk menganalisis secara yuridis normatif mengenai aturan pemberian kompensasi atau uang pesangon dari mulai pembagian besarannya dan sanksi bagi perusahaan jika melanggarnya. In this era of globalization where the economy is progressing rapidly so that many competitors have emerged in the economic sector, to create a conducive climate both in terms of the economy, permits and employment, the government created a regulation, namely the Omnibus Law which has the aim of creating a business climate and quality investment for business players, including MSMEs and foreign investors. In the field of Manpower, the Government issued Law no. 11 of 2020 and PP No. 35 of 2021 with the aim of providing legal protection and welfare for workers, but in this research it is necessary to conduct an assessment because there are deletions, updates and insertions of articles concerning labor law. Among the reforms to these regulations, what is discussed in this research is an analysis of the Specific Time Work Agreement (PKWT) rules in the Job Creation Law. There has been a change in the PKWT rules, namely workers/laborers whose contract period has expired are entitled to receive compensation money. This is a new thing, so the purpose of this research is to analyze normatively juridically regarding the rules for giving compensation or severance pay starting from the distribution of the amount and sanctions for companies if they violate it.
