IMPORTANCE OF ALTERNATIVE DISPUTE RESOLUTION MECHANISMS IN INTERNATIONAL INTELLECTUAL PROPERTY DISPUTES

Abstract

The research objective of the current article is to examine the role of alternative dispute resolution mechanisms in disputes arising from international intellectual property relations that meet modern trends. It is known that nowadays relations on intellectual property have crossed transnational borders and started to take on an international character. For this reason, the settlement of disputes arising from such relations, which contain foreign elements, by local courts creates certain difficulties. In the article, firstly, the definition of the intellectual property dispute is given, the characteristic features of such disputes are disclosed, then the reasons for the application of alternative resolution mechanisms to intellectual property disputes are investigated, the origin of their establishment is researched, and then the types of alternative dispute resolution mechanisms, their pros and cons, differences from litigation are emphasized, information about the institutions operating in this field in the international sphere is disclosed, and finally, the results and proposals emerging from the research of the article topic are noted.
