INSTITUTION OF POLICE AGENT IN PENAL LAW ORDER OF SLOVAK REPUBLIC

Abstract
In specialist literature dedicated to the functioning of police units in a number of countries, one can encounter numerous notions describing actually the same institution, namely the activity of a police officer operating under cover: the so-called police agent. In the penal law order of many countries, the terminology connected with the institution of the police agent has not been standardised yet, and one obliging notion comprising the issue has not been elaborated. The most common notions are: “a secret investigating officer”, “a police officer operating secretly”, “an officer acting under cover”, “ a hidden” or “secret agent”. Not only do we encounter a situation when practically one international and universally binding term defining this issue does not exist, but also in most European countries there are different conditions and criteria enabling the practical use of this “tool”, dedicated to cracking down on crime. This is influenced by , for instance, the implications provided to law enforcement authorities by the activity of state and international organised crime groups, which in turn oblige one to identify and define emerging threats again, and to modify and adapt the practical operations of the police, prosecution service and courts to combat this specific kind of criminal activity. For that reason, one can globally encounter numerous codes of conduct concerning the use of the police agent institution to countering crime.
