Interaction Between Divine and Secular Approaches to Human Rights

Abstract
Many regard secularism as a requisite premise of human rights promotion. From this point of view, compatibility or incompatibility between Islam and human rights depends on the possibility of secular interpretation of Islam. This claim is based on the belief that human rights belong to human beings as they are human beings. Therefore, equal enjoyment of these rights is in contradiction to the separation of individuals based on their religions and beliefs. But a religious government, due to its regulating the individual and communal relations in accordance with a single recognized religion, will necessarily turn to the separation. What this article is going to deal with is that which interpretation of religious government has more cooperation with human rights. بسیاری عرفی گرایی را به عنوان مقدمهای لازم برای توسعة حقوق بشر تلقی می کنند. از این دیدگاه، سازگاری و ناسازگاری اسلام و حقوق بشر به امکان برداشتی عرفی گرایانه از اسلام بستگی دارد. چنین ادعایی مبتنی بر این استدلال است که حقوق بشر در گفتمان تجدد حقوقی است که هر فرد به مقتضای انسان بودن از آن برخوردار است. از این رو، برخورداری یکسان از این حقوق با هرگونه تبعیض و جدا سازی بر اساس مذهب ناسازگار است. درحالی که حکومت دینی به دلیل رسمیت بخشیدن به یک مذهب و تنظیم روابط و مناسبات فردی و جمعی بر اساس آن، ناگزیر از این جداسازی است. مقاله در پی تبیین این مطلب است که کدام برداشتها از حکومت دینی تعامل بیشتری با حقوق بشر دارد.
