INTRODUCTORY CONSIDERATIONS ON THE FOREIGNERS’ CONDITION IN ROMANIA

Abstract

Until the appearance of the latest changes of the foreigners’ judicial condition in Romania, the Romanian law considered as foreigners, the people who did not have Romanian citizenship or they did not have any citizenship at all. After the latest legislative changes, by foreigners we understand “the person who does not have Romanian citizenship or the citizenship of any other state of the European Union or of the European Economic Space”. The normative act offers a clear and unitary conception on the notions of “foreigner” and “stateless” person, eliminating the ambiguous interpretations on these notions. The previous regulations did not clearly define the notion of stateless person, this being appreciated as the person without any citizenship, being assimilated to the foreign citizen. By the actual regulation we surpass this shortcoming, determining a unitary application of the law. For the first time on European plan, a common definition of the notion of foreigner was accepted which we meet in the European community law. The member states of the Schengen Agreement on the 14th of June 1985 it was established in art. 1 of the Application Convention of the Schengen Agreement signed on the 19th of June 1990, that by foreigner we understand any person other than the citizens of the member states of the European Union.
