ইসলামী বিধানে অগ্রাধিকার নির্ধারণ নীতি: একটি পর্যালোচনা |Prioritization policy in Islamic Law: An Analysis

Abstract
Due to his natural weakness and intellectual imperfection, human being is not always able to properly perform his duties and responsibilities in many places and situations. Therefore, it is necessary for an individual to know the hierarchy of time and place to accomplish a task or to avoid it based on priority. This science is called ‘Fiqhul Awlawiyyāt’ in the modern terminology of Islamic jurisprudence. This paper in adopting an analytical and descriptive method, discusses the definition, importance, authenticity and demerits of lack of understanding the science of priorities (the priorotology). It also discusses the methods of how Muslim scholars prioritized the issues, set forth conditions and capabilities for so doing, and finally theorized the science of priorities. বাস্তবতা হলো, মানুষের পক্ষে সব সময়, সব স্থানে ও সকল পরিস্থিতিতে তার সকল কাজ ও দায়িত্ব সুচারুরূপে পালন করা সম্ভবপর হয়ে ওঠে না। এটি মানুষের সহজাত সীমাবদ্ধতা ও দুর্বলতা। এ কারণে একজন মানুষকে কখন কোথায় কোন্ কাজটি অগ্রাধিকারের ভিত্তিতে সম্পাদন করতে হবে, অনুরূপভাবে কখন কোথায় কোন্ কাজটি অগ্রাধিকারের ভিত্তিতে বর্জন করতে হবে- তা জানা একান্ত প্রয়োজন। এরূপ জ্ঞানকে ইসলামী আইনের আধুনিক পরিভাষায় ‘ফিকহুল আউলাভিয়্যাত’ (فقه الأولويات) বলা হয়। বক্ষ্যমাণ প্রবন্ধে বিশ্লেষণ ও বর্ণনামূলক পদ্ধতিতে ফিকহুল আউলিয়াত-এর পরিচয়, গুরুত্ব ও প্রামাণিকতা, অগ্রাধিকার বিচার সংক্রান্ত জ্ঞানের অভাবজনিত নানা অশুভ পরিণাম, অগ্রাধিকার দানের ক্ষেত্রে ইমামগণের অনুসৃত পদ্ধতিসমূহ এবং অগ্রাধিকার বিচারের যোগ্যতা ও শর্তাবলি প্রভৃতি বিশদভাবে আলোচনা করা হয়েছে।
