Judicial and legal foundations of public rights in the light of the ideas of Imam Khomeini (RA) and Imam Khamenei

Abstract
Human is responsible before all the creation including God, his messengers, religious leaders, his coreligionists, his fellow citizens, and even the nature. He also knows that this responsibility is not free from any rights, end even if others do not respect these rights they will not be overthrown and they will be protected before God and restored to him in the hereafter. Therefore, according to this view, human is both held responsible for observing other people’s rights and is entitled to receive his own rights. From a legal perspective, such rights are considered as the main basis for law making by God and natural laws are accordingly respected and valid in social contracts. This study investigates rights of people from different perspectives in general and Islamic perspective in particular especially by focusing on the viewpoints of Imam Khomeini (RA) and Imam Khamenei. Since today issues related to human rights are among the most prominent statements and they are modeled in many cases, this study makes reference to three human rights documents: 1) Covenant on Economic, Social, and Cultural Rights, 2) International Covenant on Civil and Political Rights, and 3) Optional Protocol to the International Covenant on Civil and Political Rights. Besides, the features of the global government of justice and the way right of people are applied are discussed and in fact it is demonstrated that it is the only government that observe all aspects of right of people. The insights from this study can help people and authorities become more aware of their rights and responsibilities.
