Kobietobójstwo (feminicide) jako odrębny typ zabójstwa ze względu na płeć w prawie karnym niektórych państw Ameryki Łacińskiej ze szczególnym uwzględnieniem Meksyku

Abstract
ENG: The article aims to explain the unknown to polish lawmakers phe- nomenon of feminicides (female homicides based on gender) in Latin America with particular consideration given to Mexico. The author also tries to present the complicity of mexican criminal law which varies depedning on the state and therefore broadens the scope of legal defini- tion of feminicide. However typified in criminal codes of many countries in Latin America, feminicide as the separate type of homicide still raises doubts about the range of its legal definition and the constitutionality of its regulations. In spite of this unending legal debate, the international and human rights organizations still appeal not to eliminate this crime from criminal codes and laws as it enables to increase the transparency of the latinoamerican legal justice and what is even more significant allows to detect and makes more visible the still existing problem of impunity among the real perpetrators of gender-based violence. PL: Artykuł ma na celu wyjaśnienie nieznanego polskiemu ustawodawcy zjawiska kobietobójstw (zabójstw kobiet ze względu na ich płeć) w Ame- ryce Łacińskiej ze szczególnym uwzględnieniem Meksyku. Autorka stara się przedstawić złożoność meksykańskiego prawa karnego, które różni się w zależności od stanu, który analizujemy, co poszerza również zakres definicji legalnych kobietobójstwa. Jakkolwiek stypizowane w ustawo- dawstwach karnych wielu latynoamerykańskich państw, kobietobójstwo jako autonomiczny typ zabójstwa, wciąż budzi wątpliwości związane z zakresem jego definicji legalnej i konstytucyjnością związanych z nim przepisów. Pomimo niekończących się na ten temat debat, organizacje międzynarodowe i zajmujące się problematyką praw człowieka apelują, aby nie derogować przepisów regulujących szczególny typ penalny tego przestępstwa, ponieważ zwiększają one transparentność latynoamerykań- skich systemów sprawiedliwości oraz, co najważniejsze, pozwalają wykryć i uczynić bardziej widzialnym wciąż istniejący problem bezkarności wśród rzeczywistych sprawców przemocy wobec kobiet.
