КОНСТИТУЦІЙНІ ЗАСАДИ ОРГАНІЗАЦІЇ МІСЦЕВОГО САМОВРЯДУВАННЯ В ПОЛЬЩІ, ЧЕХІЇ, УКРАЇНІ: КОМПАРАТИВНИЙ АНАЛІЗ

Abstract

The article analyzes the principles of local self-government in Poland and the Czech Republic as the main countries of the European Union, that situated in the Eastern Europe, which were in the past in the socialist camp, in order to use the example of these countries to understand the path of reforming this sphere in order to implement the experience gained in Ukraine. The political course chosen by Ukraine for European integration determines the need to focus on European standards for the organization of public authority, including the municipal authorities. Today, local self-government bodies are the main subjects of decentralized public governance in all European states, and therefore an institutional manifestation of decentralization, and at the same time an example of special organizational and legal structures in the system of public governance, when the authorities of the lower territorial level are not hierarchically subordinated to higher authorities of territorial level. The author forms his own opinion regarding the necessary changes within the system of decentralization and local self-government in Ukraine. Local dynamism is particularly evident in Central and Eastern European countries experiencing a period of democratic transit. Poland and the Czech Republic, whose experience is important for further modernization of local self-government and territorial organization of power in Ukraine in the context of the processes of European integration and democratization, is a vivid example of a successful reform of local self-government among the countries of this region. As Ukraine plans to strengthen the European integration into the European Union at the legislative level, lawmakers and scholars in the field of local self-government has a great importance of consider the organization of local government in the member states of the European Union. The following main directions for further development of institutional and systemic structural organization of local self-government in Ukraine are defined: decentralization of public authorities; introduction of full-fledged self-government at the level of regions and districts; liquidation of local state administrations and introduction of a post authorized by the state to supervise legality and representation interests of the state; increasing the responsibility of bodies and officials of local self-government to territorial communities and ensuring the variability of the main representatives of the community; carrying out a comprehensive reform of the administrative and territorial structure of the state.
