LAW-PROVIDING COMPONENT OF THE PROCEDURAL FUNCTION OF ADMINISTRATIVE LAW: SEARCH FOR THE BASIC CRITERION TO DEFINE THE ESSENCE

Abstract
Traditional classic legal division of administrative law function to regulation and security is the result of “sustainability”, which was formed in the administrative and legal science borrowed from the Soviet Union and modern domestic scientists. The unique breadth of Administrative Law subject allows the system to complement its basic functions of another – a procedural function characteristic feature of which is the so-called external “serving” direction that “goes” beyond administrative law and provides “service-organization” as the realization of the applicants (initiative) and interference procedures established within other areas of law. Because radical reform of the legal opinion on the nature of administrative law, the question arose as to the substantial upgrade of its subject and “revaluation” functional component industry, which resulted in modern scientific, educational and journalistic sources is not only expanding the traditional range of specialized functions, but reviewing their content in context transfer of administrative and legal doctrine on so-called “European level”. Despite the fact that scientists always recognize administrative law traditionally only with two basic functions – regulation and security, it must be noted that for administrative law, as a result of the unique properties of its subject, also characterized objectively existing externally oriented integrative phenomenon – procedural branch function, the specificity of which is substantive rules of one sector (land, finance, labour, business, environmental law, etc.) “served” procedural rules of administrative law. Many modern domestic industries are new (economic, customs, tax, information law, etc.) and they lack their own procedural rules, in that case, administrative law and “help” them with their procedural rules. Recognition of administrative law procedural functions “removes from the agenda” scientific debate about the appearance of new industries – administrative and economic, administrative and land, administrative and environmental, administrative and cultural rights, etc. (e.g., research of V. Bevzenko, V. Halunko, R. Melnyk, Ye. Petrov, T. Sokolan etc.), because they actually come to the combination of substantive sector (land, environmental and economic rights) and other procedural rules – administrative law. The above combination is possible due to the specificity of administrative law and procedural nature of its integration function (which should not be confused with regulatory, because between them there is a global difference – the “external focus” procedural functions implemented outside the material administrative law). It is this feature allows you to talk about self-importance and existence of procedural tool industry is the foundation that allows you to supplement the traditional “duo” functions of administrative law. Thus, outlining our own vision of the content procedural tool industry, we consider it appropriate to note that a purposeful influence of the administrative law direction focused on external public-service provision implementing procedural material standards set within other areas of law.
