LEGAL AND CRIMINAL ANALYSIS OF APPROPRIATION OF ANOTHER PERSON’S PROPERTYINFRACTION

Abstract
Combating the phenomenon of torture is one of the basic directives of the criminal policy of our state, one of the reasons being the absolute character of torture prohibition, proclaimed by art. 3 of the European Convention on Human Rights, emphasized in more than 80 cases of conviction of the Republic of Moldova. National legislation aims to protect the person against violations brought to his or her physical and mental integrity through coercive mechanisms and instruments of the state, against illegal actions of third parties and their agents, and the investigation in all aspects, complete and objective, in particular of the cases of torture, inhuman or degrading treatment, constitutes a serious ground for the strengthening of rule-of-law state.
