LEGAL BASIS OF THE EU COMMON FOREIGN AND SECURITY POLICY

Abstract

The article analyses the stages of formation and the current state of the Common Foreign and Security Policy of the EU. Despite the special relevance and relative regulation of this issue, the practice of application has some problems, one of which is a lack of the single definition and understanding of the CFSP. The purpose of the article is studying the patterns of the formation and functioning of the common foreign and security policy of the EU, as well as determination the limits of its influence on the state of the international system. Key aspects in this are both the development of their own institutions and cooperationwith NATO. In the article the author considers concluded treaties and regulations in terms of their impact on the formation of CFSP and focuses on their importance and necessity in the relevant period. In particular, stand out: the Maastricht, Amsterdam, Lisbon treaties, Saint-Malo Declaration, «Petersberg tasks», «Berlin-Plus» agreements, etc. The article also determines the peculiarities of the functioning and dividing of powers between EU bodies and officialswho have the main levers of influence on the entire CFSP system. In the author’s opinion, the EU has not created an ideal model of the CFSP yet and continues its formation and improvement. This concerns both the institutional component and the choice of the way for further development.The EU anditsmemberschosetheroleof «softpower» intheinternationalarenaand are too used to rely in military dimension on NATO. In addition, the EU is under the influence of various geopolitical challenges, one of which is the withdrawal of the United Kingdom from the EU, which significantly influenced on the military force of the entire Union and requires its decisive actions and reformatting of the CFSP.
